UP-RERA has decided to issue a show-cause notice against Supertech Realtors

The Hon’ble Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has expressed contentions to issue a show-cause notice to Supertech Realtors under Section 5 (1) of the Real Estate (Regulation and Development) Act, 2016 (“Act”) to describe why the application for registration of Golf Country GH01-Phase-1A and Golf Country GH01-Phase-1B should not be refused.

Section 5 of the Act talks about ‘Grant of registration’. Section 5(1) of the Act states that on receipt of application under sub-section (1) of Section 4, the Authority shall within a period of 30 days:

  1. Grant Registration; or
  2. Reject application of registration while recording the reason in writing.

It is important to note that there are 2454 complaints registered against the builders and its associated companies in total out of which 1629 cases have been disposed of on the other hand 1243 and 105 are the possession and refund orders respectively.

Supertech has 36 projects registered, but the contractor has shown little interest in completing many of the unfinished projects. There are as many as 20 ventures whose registration has expired and are still unfinished.

In 5 out of 20 projects, registration has been denied because the promoter has not paid the penalty amount, and in thirteen projects, no request for project registration has been made to the authority yet.

Homebuyers have lodged a significant number of complaints against the builders, however, the builders has also failed to comply with a number of authority orders passed against them to either refund the amount or handover the possession of the units.

Earlier, in September 2020, the Hon’ble UP-RERA agreed to perform a forensic audit of Supernova Phases I, II, III, and IV of Supertech Realtors, of the Supertech Community, but the promoter refused to co-operate with the auditor, indicating non-compliance with the RERA order.
