Ministry of Housing and Urban Affairs: Uttar Pradesh, Maharashtra and Haryana accounts for 75% of the total disposed cases under RERA

As per the “Real Estate (Regulation & Development) Act, 2016 [RERA] Implementation Progress Report”, published by the Ministry of Housing and Urban Affairs on 1st of May 2021, Uttar Pradesh, Maharashtra, and Haryana account for 75% of the total disposed cases in the region. So far, 34 States/UTs have notified rules under RERA. As of April 24, 2021, according to data from the Ministry of Housing and Urban Affairs, 65,539 cases had been resolved by state authorities. Nearly 40% of the cases (26,510 complaints) were resolved in Uttar Pradesh alone, followed by 14,509 cases in Haryana and 9,265 cases in Maharashtra.

Notable Observations from the report:

Uttar Pradesh leads in number of cases “solved”

Uttar Pradesh has resolved the highest number of cases, which is again notable considering how severely Noida and Greater Noida face issues and problems due to builders and promoters.

Maharashtra leads project registrations

Maharashtra continues to lead the way in project registrations, accounting for 45 percent of all projects registered under RERA to date across 34 states/UTs. Gujarat comes in second with a 13 percent share, followed by Madhya Pradesh and Karnataka, each with around 6%, and Uttar Pradesh, with 5%.

What is the status of the Nation as a whole?

34 States/UTs have notified rules under RERA; One North Eastern State (Nagaland) is under process to notify the rules. West Bengal has enacted its own legislation, which has been challenged before Supreme Court and MoHUA has filed its affidavit to annul it.

30 States/UTs have set up Real Estate Regulatory Authority (Regular- 25, Interim- 05). Jammu & Kashmir, Ladakh, Meghalaya and Sikkim have notified the rules while yet to establish Authority.

28 States/UTs have set up Real Estate Appellate Tribunal (Regular- 22, Interim- 06). (Arunachal Pradesh, Jammu & Kashmir, Ladakh, Meghalaya, Mizoram and Sikkim are under process to establish)

Regulatory Authorities of 27 States/UTs have operationalized their websites under the provisions of RERA. (Arunachal Pradesh, Assam and Manipur are under process to operationalize).

63,810 Real Estate Projects and 50,420 Real Estate Agents have registered under RERA across the country.

66,779 Complaints have been disposed-off by the Real Estate Regulatory Authorities across the country.
