Ample grievances have come into the light through news and media where builders have turned fraudsters. Builders have been delaying the projects intentionally or unintentionally, delay in possession, false commitments etc.

RERA which was inclined to work for the protection of the interest of homebuyers was lagging behind in providing justice to homebuyers. But it has now prepared a proper redressal system to aid the rights of homebuyers.

RERA in Bihar

RERA (Real Estate Regulatory Authority) Regulation has been in enactment from 01/05/2017 with the specific object to ensure (i) transparency, (ii) accountability, (iii) grievance redressal, for real estate industry.

Bihar notified its final set of RERA Rules on 17/05/2017 which prescribe regulation, form and process for;

  • RERA registration by builders and agents
  • RERA authority constitutions
  • Filing complaints before RERA Authorities
  • Complaint redressal system

Complaint before RERA

Filing RERA Complaint in Bihar

As per Bihar RERA Rules, the complaint against the builder can be filed in Bihar RERA Authority RERA instead of consumer court or consumer forum or civil court.

RERA complaint in Bihar can be filed before following authorities depending upon the kind of grievance.

Complaint to RERA Adjudicating officer – Any complaint relating to claim of interest and compensation, which is covered by section 12, 14, 18 and 19, of RERA Act, 2016, can be filed in form ‘N’ before Bihar RERA Adjudicating officer. The complaint shall be filed with the fees of Rs. 1000/-.

Complaint to Bihar RERA Authority –

  • Any complaint relating to violations of RERA Act, or RERA Rules and regulations,
  • except those which can be filed with RERA adjudicating officer,
  • can be filed before RERA Authority in form ‘M’.
  • After paying the prescribed fees of Rs. 1000/-.

The RERA Authority shall, after following the prescribed procedure, dispose of the complaint within 60 days of filing. If it is not disposed of in said period, the officer shall record the reasons.

Complaint to Bihar RERA Tribunal – RERA tribunal is the second appellate authority.

Any person aggrieved by order of RERA authority or adjudicating officer may file the complaint to Bihar RERA tribunal in form “L” within 60 days from the date of receipt of such order after paying the prescribed fees of Rs. 5000/-.

I have booked 1bhk flate in kalawati residency projected by Agrani Homes pvt Ltd in patna with 25% booking amount at end of January 2019 with commitment, that agreement will be done just after the clearance of booking amount. But till the date,agreement has not been done by the company. Now what I can do

    1. As per RERA Act, any builder can’t accept more than 10% of cost without signed agreemen. Hence signing of agreement is compulsory. You can file case in RERA. Please send us your complete facts

  3. respected sir, mai army se hu maine agrani home pvt ltd ka ek project agrani idea me ek plot book kiya hu 21,3300 me aur 800 lac advance booking amount sep 2018 me pay kiya tha financial problem ho jane ke karan me jan 2019 me plot cancellatoon ka appl agrani company ko diya us samay bola ki 2 month me paisa refund ho jaydga apka pura lekin 7 month hone wala hai abhi tak ek bhi paisa nahi diya apr 2019 me mai office gaya agraNi ke to el letter diya jisme mention tha ki 3 monthly installment me pura amount refund kar diya jayega but abhi tak action nahi kiya koi.plz sir mujhe duty se bar bar office ka chakkar laga nahi sakta kya online complaint se action ho sakta hai.

  4. I booked dhanraj complex patna by star India construction co Ltd and cancelled on 09.02.19, but i didn’t refund my money, which I have paid of rs 100000/

      1. In terms and conditions , co will pay 75%, but after deduction of 25%. But till date he didn’t pay.

  5. I booked a plot in shine city tashi sector-1 patna (Plot no – d/65) in the month of jan 2017. I have paid all payment in may-2018. First i was given a date for the possession in october october they gave me another date in nov nov 2018 they gave another date in jan 2019 and then in 15 march 2019 and now 15 april 2019 (My associate ritu kumari from garun team is no responding properly in this matter even the ritu kumari is not picking the call.
    Everybody in the company is avoiding taking calls. I requested to kindly intimate me what step taken by me.
