The Real Estate market in Rajasthan has shown immense business potential and in past few years leading real estate developers started entering this market. Properties in Rajasthan are available at low prices and this has become the attraction for both buyers and developers.

With the development of Real Estate Industry in Rajasthan, many cases of victimization of home-buyers have also been come across. Now with the enactment of the RERA Act, 2016, the victims of the fraud can put their grievances before RERA Authorities.

  • RERA in RAJASTHAN

RERA, is a set of laws, regulations and authority by the Government to ensure (i) accountability, (ii) sustainability, (iii) grievance redressal, specifically for real estate industry. The Real Estate (Regulations and Development) Act, 2016 was commenced from 01/05/2017.

As required by RERA Act, the State of RAJASTHAN has notified its final RAJASTHAN RERA Rules, 2017 on 01/05/2017 which prescribes regulation, form and process for;

  1. RERA registration by builders and agents
  2. RERA authority constitutions
  3. Filing complaints before RERA Authorities
  4. Complaint redressal system
  • Common Complaint before RERA

Some the common issues faced by the buyer which are being filed before RERA authority/RERA Adjudicating officer are as under:

  1. Delay in possession of the Property.
  2. No refund from the Builder.
  3. No compensation for delay as promised
  4. Delay in registry
  5. Un-necessary demand by builders
  6. Non-payment of penalty for delay etc.
  • Filing RERA Complaint in RAJASTHAN

Complaints related to Real Estate now can be filed with the RERA authorities in Rajasthan. This act read with the state rules enables the Home- buyers to seek for the recourse for their grievances. Rajasthan has launched its online portal where home-buyers can file their complaint, although the procedure is very simple but professional assistance is very much required from legal point of view.

RERA complaint in RAJASTHAN can be filed before following authorities depending upon the kind of grievance.

(i) Complaint to RERA Adjudicating Officer – Any complaint relating to claim of interest and compensation, which is covered by section 12, 14, 18 and 19, of RERA Act, 2016, can be filed in form ‘O’ before RAJASTHAN RERA Adjudicating officer.. The complaint shall be filed with the fees prescribed of Rs. 1000/-.

The RERA Adjudicating officer shall, after following the prescribed procedure, dispose the complaint within 60 days of filing. If it is not disposed in said period, the officer shall record the reasons.

(ii) Complaint to RAJASTHAN RERA Authority –

  • Any complaint relating to violations of RERA Act, or RERA Rules and regulations,
  • Except those which can be filed with RERA adjudicating officer,
  • Can be filed before RERA Authority in form ‘N’.
  • After paying the prescribed fees of Rs. 1000/-.

The RERA Authority shall, after following the prescribed procedure, dispose the complaint within 60 days of filing. If it is not disposed in said period, the officer shall record the reasons.

(iii) Complaint to RAJASTHAN RERA Tribunal – RERA tribunal is second appellate authority.

  • Any person aggrieved by order of RERA authority or adjudicating officer
  • May file complaint to RAJASTHAN RERA tribunal in form “M”.
  • Within 60 days from the date of receipt of such order
  • After paying the prescribed fees of Rs. 1000/-.The RERA Tribunal shall, after following the prescribed procedure, dispose the complaint within 60 days of filing. If it is not disposed in said period, the officer shall record the reasons.

  1. Suncity projects (P) Ltd,demanding maintenance charges rs 1.45 per yard, we have already paid 50 rs per yard Rs 8134/- as interest free maint. service charges

    1. my plot no S-13,phase 2nd, Suncity Projects (P) Ltd , Sikar Road, I have taken JDA PATTA , they are demanding 1.45 per yard Maintenance charge, i have paid already 50/- rs per yard Interest free Maint. service charge for
      rs 8134/- on dt 31/8/10,

  2. My Builder has provided me reasons of non payment of compensation is:-

    1. Due to demonitisation
    2. GST
    3. Ban on Bucks
    4. Ban on Mining
    5. Pollution
    6. Late receipt of EC

    Delay of possession was for 3 years, instead of paying any compnesation they have charged heavy amount of interest without any basis to me.

    When I am asking for calculations they are saying come & sit with us, we will discuss it.

    Is it monopoly of Builders now. They are having our money for long period & at the time of possession they are harrassing us.

    What steps I can follow, pl. clarify

    it is bound to us to await the term of contract to file the complain under RERA Act as builder had not been started construction sofar. Since he had not been started construction then i am suffering a huge loss of interest. please guide me whether i approach the authority for delayed payment of interest or not

  4. I have purchased a flat in Eminent Towers Jaisinghpura, Jaipur. The builder has not completed and provided all the facilities. He took parking charges at the time registry but parking is still not ready. He has promised for 3 Lifts in each tower but gave only two. he keeps pushing us to pay Maintenance charges. Does he is authorized to charge maintenance charges for incomplete work?

Sir, I have booked a 2 BHK flat in in May 2013 at pre-launch with Avalon Rosewood Projects (A Unit of GRJ Distributors and Developers Private limited and subsequently construction linked payment were made as per contract as and when demanded by Avalon. 85% payment already paid to builder/developer. Since 2017 builder stop the construction work without any force measures. Builder buyer agreement was executed on Aug 2014. According to BBA, flat possession to be offer after 42 month i.e. February 2018. Now builder is not giving satisfactory response also Builder registered the rosewood project in RERA Rajasthan with completion date in June 20121.
    #My question from RERA Rajasthan, On what basis Rera Rajasthan registered the completion date as declared by builder without asking the BBA details?
    #Is ERA Rajasthan will bear the interest on entire amount for delyed period or force to builder for payment of interest for delayed period?
    Now I lost my trust with Avalon Group and want refund my entire money paid against flat in Avalon Rosewood.
    Kindly advice for further course of action.

Dear sir, i have a flat at Avalon royal park location bhiwadi rajasthan. they suppose to complete project in 42 months . said flat was booked on year 2012. till date they didn’t complete the project. i have taken loan from bank paying good amount of emi every month. request you suggest so i can take my money back so i can pay to bank. need suggestion.

    I have buy a flat in Trehan Delight Residency (Bhiwadi), the builder (Trehan home developer) supposed to give us possession from 1st Dec’2019 on wards but presently they are saying that they have not received OC from the UTI. Once, they received the OC then only they will start possession and registration. I am not happy with this statement. The builder might be doing such monopoly with all the customer and extending the possession date. I have paid 10% booking amount and also 90% Bank Loan sanction.

    Please guide me.
